Do I need to register a business name?

You’ll need to register a business name if you’re running a business in Australia and not trading under your own personal name.

You may not be required to register a business name if:

  • You are a sole trader using your full legal name (e.g. Anderson Lee)
  • Already in a partnership using the full names of all partners
  • Has a company operating under the same name as your registered company name

P.S.: If you’re a sole trader, you can still check business name availability before deciding to trade under your personal name.

Check your business name availability

Before you reserve your name, it’s worth checking if someone else is already using it.

Our name checker shows whether your business name is taken or too similar to an existing one. It helps you avoid legal trouble and gives you the green light to move forward confidently.

You’ll also get a heads-up on whether the domain name is free; a valuable bonus if you’re planning to take your business online.

Identify other registrations you might need

Starting a business involves understanding necessary registrations beyond just the business name, depending on your structure (sole trader, company, or trust).

Identifying these on upfront makes the whole process smoother and saves you time down the line.

Apply for your business name

Once your name’s available and you’re clear on what else you need, it’s time to register.

You can register your business name directly or use a trusted registration provider like us to make the process easier and quicker. Either way, you’ll be meeting ASIC requirements and setting yourself up to operate legally.

Protect your business with a trademark

Registering your business name is a great start, however,  it doesn’t give you exclusive rights to that name. To fully protect your brand, logo or business identity, you have to consider registering a trade mark.

A trade mark gives you exclusive rights to use your brand in Australia, helps prevent others from using it on similar goods or services, and lets you license it if needed. It’s a smart way to secure your brand for the long term.

Frequently Asked Questions

What types of companies can be registered in Australia?

You can register several types of companies in Australia, but the most common is a proprietary limited company (Pty Ltd). Other types include public companies, not-for-profit organisations, and special purpose companies. Each structure has different rules and reporting obligations.

What documents are required for this process?

You’ll need a few basic details to get started: the proposed company name, registered office address, principal place of business, and details of all directors and shareholders. Identification documents may also be required, depending on your structure.

How long does it take to register a company?

Once you submit all the required details, company registration can be completed in as little as one business day. Delays may occur if any information needs to be clarified.

Can I use the same business name as someone else in a different state?

No. Business names are registered nationally with ASIC, so if a name is taken anywhere in Australia, it’s off-limits to you too.

What happens if I use an unregistered business name?

You could face penalties, and you won’t be legally allowed to trade or sign contracts under that name.

What’s the difference between a business name and a trademark in Australia?

A business name lets you operate under a chosen name. A trademark gives you exclusive legal rights to your brand elements, like your name, logo, or tagline.

Why is it important to check a business name before registering?

To make sure the name’s not already taken or too close to an existing one. It saves you from rejection or legal issues down the track.

Can two businesses have similar names in Australia?

Sometimes, but ASIC might reject a name if it’s too close to an existing one and could cause confusion. If the names could confuse customers or imply a connection between two unrelated businesses, your application might not go through. It’s best to aim for a name that’s clearly distinct.

Does checking a business name also check domain availability?

No, but we can guide you on checking and securing a domain separately.

How much does it cost to register a business name in Australia?

ASIC fees start from $42 for one year. You also have the option of registering for 3 years but at a higher fee.

Do I need an ABN to register a business name?

Yes, you need an Australian Business Number (ABN) before you register. If you don’t have one yet, you’ll need to apply for an ABN first. The process is straightforward, and you can apply online in just a few minutes. Once it’s active, you can proceed with your business name registration.

Can I register multiple business names under one ABN?

Yes, you can, as long as they’re listed properly.

Can I reserve a business name in Australia?

No, business names can only be secured through full registration. There is no hold or pre-book option.

Are there any legal obligations as a company director after registering?

Yes. As a company director in Australia, you have ongoing legal duties. These include keeping company records up to date, meeting tax obligations, ensuring the company operates lawfully, and acting in the best interests of the company at all times.
